Disclaimer: In case of any discrepancy or difference, the English version will take precedence over the translation.

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name https://flickori.com/ (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”).

Company and User Definitions

The Platform is owned by Vertex Vantage Technologies Pvt Ltd, a company with its office at 303-A, NBC Complex, Plot 43, Sector 11, CBD Belapur, Navi Mumbai, Maharashtra (hereinafter referred to as “Flickori”).

Your use of the Platform and its services is governed by the following terms and conditions (“Terms of Use”). By using the Platform, You are contracting with Vertex Vantage Technologies Pvt Ltd and these terms constitute Your binding obligations with Flickori.

• For the purpose of these Terms of Use, “You” or “User” shall mean any natural or legal person who has agreed to become a buyer on the Platform.
• The term “We”, “Us”, “Our” shall mean Vertex Vantage Technologies Pvt Ltd.

ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Flickori Policies (including but not limited to our Privacy Policy) as amended from time to time.

Membership Eligibility

Transaction on the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” under the Act, including minors (under 18 years) and un-discharged insolvents, are not eligible. If you are a minor, you may use the Platform only under the supervision of a parent or legal guardian. Flickori reserves the right to terminate your membership if it is discovered that you are a minor transacting on the Platform.

Your Account and Registration Obligations

You are responsible for maintaining the confidentiality of your Display Name and Password and for all activities that occur under your account. If you provide any information that is untrue, inaccurate, or incomplete, We have the right to suspend or terminate your account indefinitely. Your mobile number and email address are your primary identifiers, and you are responsible for keeping them up to date.

Communications

When you use the Platform or communicate with us, you consent to receive communications from us electronically (via email, SMS, or other modes) periodically and as required.

Platform for Transaction and Communication

The Platform is a venue that enables Buyers and Sellers to transact. Flickori is not a party to and does not control any transaction between the Platform’s Users.

• All commercial/contractual terms (price, shipping, warranties, etc.) are offered by and agreed to between Buyers and Sellers alone.
• Flickori does not make any representation or warranty as to the specifics (quality, value, etc.) of products or services on the Platform.
• Flickori is not responsible for any non-performance or breach of any contract between Buyers and Sellers.
• The contract for sale is a strictly bipartite contract between the Seller and the Buyer.

Business Purchases & GST Invoice

Select products may be eligible for business purchases. Upon your request, a Tax Invoice containing the GSTIN you provide shall be issued by the Seller. Our GSTIN for reference is 27AAKCV5436E1Z5. You are responsible for providing accurate details and agree to indemnify Flickori and the Seller from any liability arising from incorrect information.

Disclaimer: Pricing on any product may be incorrectly reflected due to technical issues or typographical errors, in which case the seller may cancel your order.

Use of the Platform

You agree and undertake that your use of the Platform shall be strictly governed by laws and principles that prohibit illegal, harmful, defamatory, or infringing activities. You shall not use automated means (“bots,” “spiders”) to access the Platform or attempt to gain unauthorized access. You must comply with all applicable laws, including but not limited to the Information Technology Act, 2000, and Foreign Exchange Management Act, 1999.

Privacy

We view the protection of your privacy as a very important principle. Our current Privacy Policy details how we store and process your information in accordance with the Information Technology Act, 2000. If you object to your information being used as described, please do not use the Platform.

Disclaimer of Warranties and Liability

This Platform and all materials and services are provided on an “as is” and “as available” basis without any representation or warranties, express or implied. Flickori will not be liable for any damages arising from the use of this Platform.

Payment

While availing any payment methods on the Platform, both Parties will be liable for any loss or damage arising from a lack of authorization, exceeding preset limits, or other payment issues. 

Both parties are liable for the payment issue.

Flickori’s Replacement/Return Policy

Flickori aims to assist Buyers with defective, damaged, or incorrect items. The policy for return or replacement is subject to the terms and conditions outlined in our detailed Cancellations and Returns policy page.

Applicable Law

These Terms of Use shall be governed by and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Navi Mumbai, Maharashtra.

Trademark, Copyright, and Restriction

This site is controlled and operated by Flickori. All material on this site, including images, illustrations, and clips, is protected by copyrights, trademarks, and other intellectual property rights. Material on the Platform is solely for your personal, non-commercial use.

Limitation of Liability

IN NO EVENT SHALL FLICKORI BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THESE TERMS OF USE, EVEN IF THE USER HAS BEEN INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.
